Community - Terms of use
At Vivaldi Technologies AS (“Vivaldi”), we try to keep things as simple and easy as possible, but since this is a legal document, it’s a bit longer than we would like it to be. It’s important that you read this carefully and understand the Terms of Use.
Vivaldi wishes to ensure that you receive information about any development or updates to the services as well as Vivaldi Browser and will therefore send you such information to the email address you registered your account with or to your Vivaldi Webmail address, once you’ve started using the service. You can unsubscribe at any time by clicking the “unsubscribe” link at the bottom of each email, updating the subscription status on your account’s profile or visiting https://vivaldi.com/newsletter/unsubscribe/.
By using Vivaldi services, you agree to the following terms and conditions, which apply to all Vivaldi services (webmail, blogs, forums, sync, social and themes) made available to the Vivaldi Community.
What you agree to do
- Provide true, accurate, current and complete information about yourself as prompted by the sign-up process.
- Be fully responsible for all activities that occur under your account and any other action taken in connection with the account.
- Notify Vivaldi of any unauthorized use of your information, your account or any other security breaches.
- Follow our Code of Conduct.
- Respect the intellectual property rights and privacy of any third party and only publish content or other material that you have full rights for.
- Disclose the use of generative artificial intelligence tools in your content.
- Accept our Privacy Policy.
- Use our services at your own risk.
- Be fully responsible for any claim, expense, liability or losses arising from any infringement of these Terms of Use.
- Abide by all applicable local, state, national and international laws and regulations and adhere to the guidelines in the next section.
What you agree not to do
- Harass, intimidate or threaten other members of the community.
- Post illegal content or other material for which you don’t have rights to publish/distribute.
- Post content or material that is obscene, defamatory, vulgar, sexually oriented, hateful, harassing or threatening.
- Use our service for illegal purposes.
- Hack our system or use our system to hack other systems and spread viruses, spam to other users or to any other third party.
- Create or use multiple accounts to abuse Vivaldi policies, bypass Vivaldi account limitations, circumvent filters or otherwise subvert restrictions placed on your account. (For example, if you’ve been blocked by another user or have had your Vivaldi account disabled due to abuse, don’t create a replacement account that engages in the similar activity.)
- Create Vivaldi accounts by automated means, or buy Vivaldi accounts from, sell or re-sell them to, or trade them with others.
- Distribute spam or unsolicited commercial content.
- Post content with the sole purpose of driving traffic and increasing the search rankings of another website, product or service.
- Post duplicate content (content that has been previously posted on other websites) for the purpose of backlinking. Occasionally, duplicate content can be posted as a guest post. It has to be mentioned clearly in the post.
- Post content that is clipped or incomplete with the sole purpose of linking to the full article on another website. We consider this to be backlinking.
- Post content to promote bounty campaigns or to inflate rankings for specific posts, accounts, businesses, or products.
- Facilitate gambling or betting.
- Repeatedly post comments or alternative interactions to promote products.
- If a post contains affiliate links, you must clearly disclose this. For instance, with language such as: “This post includes affiliate links; I may receive compensation if you purchase products or services from the different links provided in this article.”
- It is prohibited to use Vivaldi Community services to distribute:
- Content which violates the CAN-SPAM Act or other anti-spam laws.
- Unauthorized content via open, third-party servers; or to distribute the email addresses of any person without their consent.
- It’s not allowed to automate the Vivaldi Community services interface. This means that you cannot send, delete or filter content in a manner that misleads or deceives users.
- When a user marks some content as spam, it increases the likelihood that future content that you send will also be classified as spam by the spam filter that we use and run locally.
- Malware
You will not use Vivaldi Community services to knowingly transmit or upload any material that contains viruses, trojan horses, worms, time bombs, cancelbots, or any other harmful or deleterious programs. In addition, you will not distribute content that harms or interferes with the operation of networks, servers or other infrastructure belonging to Vivaldi or others. - Fraud, phishing and other deceptive practices
- Unless you have their explicit permission, you will not access another user’s Vivaldi Community account.
- Don’t use Vivaldi Community services to trick, mislead or deceive other users into sharing information under false pretenses.
- Don’t phish for users’ data, such as login information, passwords, financial details or identification numbers, or use Vivaldi Mail as part of a scheme to defraud others.
What we agree to
We do our best to provide the best community environment; however, we cannot be liable for any kind of damage, direct or consequential, resulting from your use of our Website.
We do not guarantee that access to our Website will always be available or uninterrupted.
The Website and all the Website elements are provided on an “as is” basis. This means that we cannot guarantee the accuracy and timeliness of information available.
The information on the Website is not prescreened or censored by Vivaldi (with the exception of shared themes on themes.vivaldi.net), but we may remove any information posted on the Website without notice, if we have reason to believe that it violates the Terms of Use. Vivaldi is not responsible for any failure or delay in removing such material.
We are not responsible or liable for content or services provided by any third-parties, that may be used on or linked from the Website.
Please note that the email quota is of 10GB. As soon as your account reaches critical size, Vivaldi will send you a warning message. An account that has exceeded the quota limit will be blocked from receiving mail and from storing new messages. In such a case, you will not be able to send or receive mail.
Please note that if you delete your data, including but not limited to your topics and comments on the forum, we will not be able to restore it for you.
The content and material you publish on our forums, blogs, social and themes is yours only, and Vivaldi does not claim ownership to any of your uploads. We only use, copy, display, distribute and adapt your content for the purpose of running the forums, social and blog services. By accepting these Terms of Use through your continued use of the services, you grant Vivaldi an irrevocable license to do so.
Termination
You can choose to end the agreement at any time, for any reason, by deleting your Vivaldi account and discontinuing your use of the services. When doing so, your data is permanently deleted from all our servers, and your username can never be re-used.
We may suspend or terminate your access to the services or remove any of your content at any time for any reason (not limited to the list below), if we reasonably believe:
- You have provided any information that is untrue, incomplete, inaccurate or outdated.
- You have violated these Terms.
- You create risk or possible legal exposure for us.
- Our provision of the Services to you is no longer commercially viable. Vivaldi has no obligation to store or make available the contents of terminated accounts.
If you violate any of the Terms, in addition to your account being suspended or terminated, you may be exposed to civil and criminal sanctions.
We will make reasonable efforts to notify you by the email address associated with your Vivaldi account or the next time you attempt to access the Services.
Inactive account policy
Vivaldi’s inactive account policy
We encourage people to actively log in and use Vivaldi services when they register an account. To keep your account active, be sure to log in at least once every 6 months. Accounts and their contents may be permanently removed due to prolonged inactivity.
How is inactivity determined?
Inactivity is based on a combination of participating in community activities on the forum, blogs, social and themes, using the browser’s sync feature or webmail. Therefore, unconfirmed or mass-produced accounts without virtual practice in any of these community activities are also subject to permanent removal at any time. Please note that you may not be able to tell whether an account is currently inactive, as not all signs of account activity are publicly visible.
Child safety
Vivaldi has a zero-tolerance policy against child sexual abuse imagery. If we become aware of such content, we will report it to the Norwegian Police Department, as required by law. We may also take disciplinary action, including termination, against the Vivaldi Mail accounts of those involved.
Copyright
You will respect copyright laws in your use of Vivaldi Community services and will not infringe on the intellectual property rights of others, including patent, trademark, trade secret or other proprietary rights.
You are also not allowed to encourage or induce others to violate intellectual property rights. You can report copyright infringement to Vivaldi at vivaldi.com/contact.
Illegal activity
Keep it legal. Don’t use Vivaldi Community services to promote, organize or engage in unlawful activities.
Message storage, file storage, outbound messages and other limitations
The amount of storage space per user is limited. Some sent or received content, or uploaded or downloaded files, may not be processed due to space constraints or other limitations. You agree that Vivaldi is not responsible or liable for the deletion or failure to store messages, files or other information.
Policy enforcement
You can report abuse at vivaldi.com/contact.
Vivaldi may disable accounts that are found to be in violation of these policies. If your account is suspended, and you believe that it was a mistake, please contact us.
